4BusinessHosting is committed to a zero-tolerance, anti-Spamming policy. Under this policy, we prohibit Spam, or any unsolicited commercial email, from being sent either:
Over the 4BusinessHosting network, by customers or any other users of the 4BusinessHosting network (including customers' customers); AND/OR over ANY network if the message sent advertises or mentions a site hosted on the 4BusinessHosting network.
Violators of 4BusinessHosting anti spam policy will be charged $500.00 for every unsolicited message involving 4BusinessHosting network.
We react quickly and seriously to violations, and we further reserve the right to terminate the services of any customer willfully disregarding this policy.
If you have any complaints or comments regarding Spam on our network, please direct them via email to support@4businesshosting.com. There are no exceptions to this policy.

Acceptable Content:
You cannot use the 4BusinessHosting network for storage, transmission or presentation of any information in any violation of US Federal or State law. This includes, but is not limited to: unlawful redistribution of any copyrighted material, obscene, racist, or hate publications, or any links to such content. You agree to indemnify and hold 4BusinessHosting harmless from any claims resulting from the misuse of our service.
Pornography is prohibited on our network. This includes sites that may imply any pornographic content, or link to such content elsewhere.
You cannot use the 4BusinessHosting network to promote any activities considered illegal in the United States, the State of Maine, or your home state or country.
4BusinessHosting does not allow the hosting of sites of its competitors or web pages promoting sites of its competitors.

Under no circumstances shall 4BusinessHosting be liable for any direct, indirect, special, punitive, or consequential damages that result in any way from your use of or inability to use the service, or for third parties' use of the service to access your Web space, or to access the Internet or any part thereof, or your or any third parties' reliance on or use of information, services, or merchandise provided on or through the service, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation or transmission, or any failure of performance. If you are dissatisfied with 4BusinessHosting service or any of its terms, conditions, rules, policies, guidelines, or practices, your sole and exclusive remedy is to discontinue using the service. You understand that by placing information on 4BusinessHosting's servers that such information becomes available to all Internet users and that 4BusinessHosting has no way of limiting or restricting access to such information or protecting such information from copyright infringement. You assume total responsibility and risk for your use of 4BusinessHosting's servers and the Internet. It is solely your responsibility to evaluate the accuracy, completeness, and usefulness of all opinions, advice, services and other information, and the quality and merchantability of all merchandise provided through 4BusinessHosting or on the Internet generally.

Data Loss/Backup:
Your use of the service is at your sole risk. 4BusinessHosting is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on 4BusinessHosting servers. 4BusinessHosting maintains RAID Mirror Drives to protect against hard drive failure, this provides an up to the second "backup" copy of your data but in no way protects your data except in the case of hard drive failure.

NSF and Chargebacks:
If your credit card on file is declined 4BusinessHosting reserves the right to charge you a $10.00 fee for each decline after the first. 4BusinessHosting doesn't charge you for your first decline but can and will charge you for each subsequent decline.
If you send in a check that is declined 4BusinessHosting reserves the right to charge you a $25.00 fee.
If your credit card issuer issues a chargeback for charges posted to your credit card on file 4BusinessHosting reserves the right to charge you a $25.00 fee.

Changing your Service:
If at any time you decide to change your service you must contact us via email at sales@4businesshosting.com to request the change. Fees for changing of your service apply as follows:
- There are no additional fees to upgrade your service either by going to a higher level hosting plan or by going to a longer term on your current hosting plan
- If you are downgrading to a lower level hosting plan or changing from a longer term to a shorter term then labor fees equivalent to the setup fees for your current hosting plan are applied
The reason we charge fees for down grading and don't for upgrading is because either way takes a bit of work to change your hosting plans, changing your billing, etc...
If you're upgrading then we're going to be making more money and can wave the labor charges involved in the change, but if you're downgrading we still have to do the work and at the same time we're making less
so we have to charge the setup fees to cover the labor.

Canceling Service:
If at any time you decide to cancel your service with 4BusinessHosting you MUST complete the following steps:
- Pay any and all balances
- Notify us via email and/or phone that you are canceling your service
- Login to the Hosting Control Panel Domain Menu and delete your domain
- Notify us via email and/or phone that you have deleted your domain and request that we remove your account
Failure to complete all of the above steps will result in your account and billing not being closed and you will be liable for continuing service until such time as you complete the cancellation of your account.

Fees Associated with canceling your account:
This are no fees charged for canceling your account with 4BusinessHosting, however, if you require additional services from 4BusinessHosting to complete your cancellation of services the following fees will apply:
- Temporary DNS Redirect - $50.00
- SSL Certificate Exportation - $50.00
- Web Site Backup Made Available (.ZIP) - $50.00
- MS-SQL Database Backup or Detached Copy Made Available - $75.00
*Note that the fees listed above are for the labor, resources, and time needed to complete the service only and are non-negotiable
DNS Redirects can be done at the registrar from who you purchased your domain
SSL Certificates can be reissued through the issuing comapny
Web Site Backups can be done by the customer via FTP or FrontPage
MS-SQL Databases can be exported via several methods

Refunds:
4BusinessHosting has a 30 day money back guaranty. No refunds will be issued after 30 days. There are no exceptions.

Refusal or Discontinuance of Service:
4BusinessHosting reserves the right to refuse or discontinue service to anyone at 4BusinessHosting's sole discretion. 4BusinessHosting's may deny you access to all or part of the service without notice if you engage in any conduct or activities that 4BusinessHosting's in its sole discretion believes violates any of the terms and conditions in this agreement. 4BusinessHosting's shall have no responsibility to notify any third-party providers of services, merchandise, or information, nor any responsibility for any consequences resulting from such discontinuance or lack of notification. You agree that 4BusinessHosting's has the right to monitor the service electronically from time to time and to disclose any information as necessary to satisfy the law, or to protect itself or its subscribers. 4BusinessHosting's reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unacceptable, undesirable, or in violation of this agreement.

Indemnification:
You agree to indemnify, defend, and hold harmless 4BusinessHosting from any and all liability, penalties, losses, damages, costs, expenses, attorneys' fees, causes of action or claims caused by or resulting indirectly from your use of the service which damages either you, 4BusinessHosting, or any other party or parties without limitation or exception. This indemnification and hold harmless agreement extends to all issues associated with your account, including but not limited to domain name selection and Web site content.

Severability:
If any provision of this agreement is determined to be invalid or unenforceable, all other provisions shall remain in full force and effect and said provision shall be reformed only to the extent necessary to make it enforceable.

Applicable Law, Jurisdiction, and Service:
This agreement shall be governed by the applicable laws of the State of Maine, USA ("Maine") and the United States of America. Customer agrees that all services provided by 4BusinessHosting shall be deemed to have been requested and provided in York County, Maine. Customer further agrees that the County Court of York County, Maine, shall have personal jurisdiction over Customer and exclusive subject matter jurisdiction over any and all claims or controversies arising from or relating to this agreement or the services provided by 4BusinessHosting. Customer agrees to accept service of process related to this agreement by ordinary mail, postage prepaid, to the most recent address provided by Customer.
